How we collect, use, share and protect your personal data, and the rights you have over it.
This Privacy Policy explains how Capital Link, a partnership firm constituted under the Indian Partnership Act, 1932, with its principal place of business at Flat No. 202, Shree Ram Apartment, Plot No. 65, Kotwal Nagar, Khamla, Nagpur – 440015, Maharashtra, India (“Capital Link”, “we”, “us”, “our”) collects, uses, shares, stores and protects your personal data.
It applies to personal data we process through our website capitallinkfirm.com (the “Website”), by telephone, WhatsApp, SMS and email, and offline while assisting you with a loan, credit card or other financial product (together, our “Services”).
It is published in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules made under it, the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to the extent applicable.
By using the Website, submitting an enquiry, or providing your information or documents to us, you acknowledge that you have read and understood this Privacy Policy and consent to the processing of your personal data as described in it.
Capital Link is a Direct Selling Agent (DSA). We help customers identify suitable financial products and assist them in applying to banks and non-banking financial companies (“Lenders”). We are not a bank, NBFC or lender, and we do not take lending decisions.
We act as the Data Fiduciary for personal data we collect directly from you. When we pass your data to a Lender for your application, that Lender processes it as an independent Data Fiduciary under its own privacy policy and legal obligations, which govern its use of your data from that point.
(a) Information you give us through the Website: your name, mobile number, email address, city, the type and amount of loan you are interested in, your employment type, and any message you choose to write.
(b) Information and documents you give us during loan or card processing (usually offline, by visit, email or WhatsApp), which may include:
Some of this, such as financial information, is “sensitive personal data or information” under the 2011 Rules. We collect it only because it is necessary for the Lender to process your application.
(c) Information collected automatically: when you use the Website, our analytics and hosting providers collect technical information such as IP address, browser and device type, pages viewed, referring website, approximate location (city level) and time of visit, through cookies and server logs (see section 11).
Data of other people: if you give us personal data of a co-applicant, guarantor, family member or any other person, you confirm that you are authorised to do so and that you have informed them of this Privacy Policy.
We use your personal data only for the following purposes:
We do not sell your personal data, and we do not use it for any unrelated purpose without first obtaining your consent.
We process your personal data on the basis of the consent you give when you submit an enquiry or provide your information or documents to us, and, where the DPDP Act permits, for certain legitimate uses such as complying with law.
You may withdraw your consent at any time by writing to the Grievance Officer (section 15). Withdrawal will not affect processing done before it. After withdrawal we will stop processing your data, except where we are required by law to retain it. Please note that if you withdraw consent, we will not be able to continue assisting you, and a Lender may not be able to process an application that is already in progress. Data already shared with a Lender is governed by that Lender’s policy, and you should contact the Lender directly.
We share your personal data only to the extent necessary for the purposes in section 4, with:
Some of our technology service providers store or process data on servers located outside India. Such transfers are made as permitted by the DPDP Act and are not made to any country or territory restricted by the Central Government.
After the applicable period, personal data is deleted or anonymised.
We follow reasonable security practices proportionate to the nature of the data, including encrypted (HTTPS) connections to the Website, restricting access to personal data to partners and staff who need it, using reputable service providers, and securing physical documents.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a personal data breach occurs, we will take steps to contain it and notify the Data Protection Board of India and affected persons as required by law.
Please also take care with your own data: send documents only to the contact details listed in section 10.
Capital Link never asks you for an OTP, PIN, password or CVV, and never charges you any fee. We are paid by Lenders, not by customers. We never ask you to transfer money to an individual’s account to get a loan approved.
